The Gujarat Electricity Regulatory Commission (GERC) has given renewable energy developer Onix-Two Enersol Private Limited a final opportunity to pursue its petition related to a 40 MW wind-solar hybrid power project before taking a final decision in the matter. The direction was issued in a daily order after a hearing held on July 30, 2026, before a bench comprising the Chairman and Members.

The petition was filed under Section 86 of the Electricity Act, 2003. Onix-Two Enersol had requested an extension of the scheduled commissioning date for the power evacuation infrastructure required to connect its 40 MW hybrid power project to Gujarat Energy Transmission Corporation Limited’s (GETCO) 66 kV Sutrapada Sub-Station. The company argued that unforeseen circumstances beyond its control had delayed the construction of the transmission line and associated substation facilities.

During the hearing, the advocates representing Onix-Two Enersol informed the commission that they could no longer continue appearing for the company because they had received no instructions from their client. They stated that after the previous hearing on April 7, 2026, they repeatedly attempted to contact the developer to prepare a rejoinder and obtain updates on the project’s progress but did not receive any response. As a result, they sought permission to withdraw from the case and requested that future notices be sent directly to the company.

GETCO opposed the continuation of the petition and urged the commission to dismiss it. The transmission utility argued that the extension sought by the developer was only up to March 31, 2026, and that date had already passed. It also informed the commission that no physical progress had been made on the construction of the evacuation infrastructure or the required substation works.

GETCO further submitted that the pending litigation was blocking valuable transmission connectivity, preventing the utility from cancelling the unused allocation and making the available capacity accessible to other eligible applicants. It requested the commission either to dismiss the petition for non-prosecution or clarify that the pending proceedings do not restrict GETCO from exercising its statutory powers to revoke the connectivity.

During the hearing, the commission asked GETCO to carry out a physical inspection of the project site and submit a detailed status report. GETCO agreed to do so and was directed to file its affidavit by August 13, 2026.

The commission also instructed the petitioner’s advocates to submit a formal discharge application, along with proof that the company had been notified, by the same date. While giving Onix-Two Enersol one final opportunity in the interest of natural justice, GERC directed its registry to issue a fresh notice to the company’s registered address and email. The commission made it clear that if the developer fails to appear or continue the proceedings at the next hearing, the matter will be decided in accordance with law without granting any further opportunity.
